Privacy Policy and PDPA Notice

This notice is issued under the Personal Data Protection Act 2010 of Malaysia (“PDPA”). It explains what personal data PenangPropertyHub (“we”, “us”, “our”) collects, why we collect it, who we share it with, and the choices and rights you have.

1. Who we are

PenangPropertyHub is an independent website based in Penang, Malaysia. For privacy matters, contact info@penangpropertyhub.com.

2. Personal data we collect

Information you give us

When you fill in an enquiry or register-your-interest form, we collect:

• Your name,
• Your email address,
• Your contact (phone) number, and
• The page or project you were viewing when you submitted the form.

If you write to us by email or through a contact form, we also collect the content of your message.

We do not ask for, and you should not send us, financial account details, identity document numbers, or copies of identity documents through these forms. Those are collected directly by the developer's sales gallery or your solicitor at the appropriate stage.

Information collected automatically

When you visit the website, our systems and our service providers may collect technical data such as your IP address, browser and device type, language, pages viewed, time spent, referring website, and approximate location. This is collected using cookies and similar technologies (see section 8).

3. Why we collect your personal data

We use your personal data to:

• Respond to your enquiry and send the brochures or information you requested;
• Pass your enquiry to the partner handling the property you are interested in, so they can contact you;
• Operate, maintain, secure and improve the website;
• Understand how visitors use the website (analytics);
• Show advertisements, including through Google;
• Keep records, handle complaints, and meet legal obligations.

It is voluntary to give us your personal data. However, if you do not provide the details marked as required on a form, we will not be able to process your enquiry.

4. Who we share your personal data with

Information submitted to us through our site will be shared with parties partnered with us on the respective property. These parties can include:

• The property developer of the project you enquired about, and its appointed sales or marketing representatives;
• Authorised sales partners and agents handling that project;
• Service providers that help us run the website, such as hosting, email, analytics and data storage providers (for example, the Google services we use to record enquiries); and
• Regulators, courts or law enforcement where we are legally required to disclose information.

These partners will contact you directly with regards to your enquiry. Once your information is shared, each partner handles it under its own privacy practices, and we encourage you to read their privacy notices. We do not sell your personal data to unrelated third parties.

5. Your consent

By submitting your information on our website, you consent to us collecting, using and sharing your personal data as described in this notice. In particular, you grant us the right to share your information with third-party partners who will be contacting you directly with regards to your enquiry. The form includes a consent checkbox. We keep a record of the time you gave your consent and the version of this notice you agreed to.

Suggested wording for the form checkbox:

“I agree that PenangPropertyHub may share my name, email and contact number with its partners for this property, who may contact me about my enquiry, in accordance with the Privacy Policy.”

6. You can withdraw consent

You may withdraw your consent, or ask us to stop sharing or using your personal data, at any time by emailing info@penangpropertyhub.com. We will act on your request within a reasonable time. Withdrawing consent will not affect partners who have already received your details; for those, please contact the partner directly, and we will help you identify who they are. Withdrawal may mean we can no longer respond to your enquiry.

7. Advertising and Google

To sustain our effort, we partner with Google for the advertisements that appear on our website. Google and its advertising partners may use cookies and similar technologies to show you ads based on your visits to this and other websites, and to measure how ads perform.

• You can manage or turn off personalised advertising through your Google Ads Settings.
• You can read how Google uses information from sites that use its services on Google's own privacy and partner-site pages.
• Advertisements on our site are provided by third parties. We do not control their content, and their use of your data is governed by their own policies.

8. Cookies and similar technologies

We use cookies and similar tools for:

• Essential functions: security, language choice, and remembering your consent.
• Analytics: understanding how the website is used (for example, Google Analytics).
• Advertising: serving and measuring ads (for example, Google).

When you first visit, a cookie banner lets you accept or manage non-essential cookies. You can also change settings in your browser. Blocking some cookies may affect parts of the website.

9. Transfers outside Malaysia

Some of our service providers, including Google, may store or process data on servers outside Malaysia. We take reasonable steps so that your data is handled with appropriate protection, in line with the PDPA.

10. How long we keep your data

We keep enquiry details for as long as needed to handle your enquiry and for 24 months afterwards, unless the law requires us to keep them longer or you ask us to delete them. Analytics data is kept for the period set in our analytics settings.

11. Security

We take reasonable and practical steps to protect your personal data, including encrypted connections (HTTPS), restricted access, and secure storage. No internet transmission is completely secure, so we cannot guarantee absolute security. If a data breach affecting you occurs, we will act as the law requires.

12. Your rights

Under the PDPA you may ask us to:

• Confirm whether we hold personal data about you and give you a copy;
• Correct data that is inaccurate, incomplete or out of date;
• Stop using your data for direct marketing; and
• Withdraw or limit your consent (see section 6).

To make a request, email info@penangpropertyhub.com with your name and the details of your request. We may ask you to verify your identity, and we may charge a reasonable fee where the law allows.

13. Marketing messages

If you receive marketing messages from us, every message includes a way to opt out. Partners who contact you directly are responsible for their own marketing and opt-out options.

14. Children

This website is intended for adults. We do not knowingly collect personal data from anyone under 18. If you believe a child has given us data, contact us and we will delete it.

15. Links to other websites

Our pages may link to developer websites and other third-party sites. We are not responsible for their content or privacy practices.

16. Language

This notice is provided in English, the language of this website. The Personal Data Protection Act 2010 requires that certain consents and privacy notices be made available in Bahasa Malaysia as well; where a Bahasa Malaysia version is published on this site, it is made available alongside this notice. If there is any inconsistency, the English version prevails.

17. Changes to this notice

We may update this notice from time to time. The latest version will be on this page with its updated date. Continued use of the website after changes means you accept the updated notice.
